Date 05/08/2026, USCIS announces an updated policy to tighten the standard of proof for U.S. immigration benefits applications. Under the new policy, applicants need to proving eligibility at the time of submission and provide a full range of initial evidence as required by each type of application.

🔎 Is RFE “abrogated”?
No.
RFE – Request for Evidence – remains a tool that USCIS can use when additional evidence is needed.
The key change points are: USCIS no longer defaults to sending RFE or NOID before denying applications in cases where the applicant fails to prove the conditions or fails to provide compulsory initial evidence.
⚠️ Profiles that need special attention
A profile may be at risk if:
- ❌ Missing initial evidence required according to the instructions of the application form.
- ❌ Do not prove that you meet the conditions of the visa / benefits are applying.
- ❌ The application has no legal basis for approval.
- ❌ Forms, signatures, fees or requests for submission are not properly implemented.
In these cases, waiting for USCIS to send RFE to “correct records” is no longer a safe strategy.
📌 Who does this affect?
This policy applies not only to a single program but also to applications for immigration benefits approved by USCIS, including many groups settlement, labor and non-settlement.
For labor records such as EB-3It is especially important to prepare evidence from the beginning because the record is often multi-component and must demonstrate a variety of conditions.

💡 What should the applicant do?
Before submitting your application to USCIS, you should:
✅ Check the right form and form version is being requested by USCIS.
✅ Compare all checklist initial evidence.
✅ Check signature, fee and payment method.
✅ Ensure documents are consistent and consistent with the information declared in the application.
✅ Do not build profiles according to psychology “Unless USCIS asks RFE later”.
RFE can still be submitted by USCIS when the officer sees that additional evidence is needed. However, as of August 5, 2026, applicants should not assume that they will always have an opportunity to supplement their application before being rejected.
👉 The most important message: With the new policy, the quality of the application at the time of submission It's more important than ever.
The above information is an update of general policy, does not replace legal advice for each specific dossier.
