
- What is a Guardian Visa in Australia?

This is a student guardian visa known as Visa Subclass 590. This type of temporary residence visa is for parents, guardians or adults over 21 years of age who are authorised by their parents/guardians to care for students under 18 years of age; or over 18 years of age who require special care. Applicants can stay in or outside of Australia when applying for this type of visa.
2. Who can become a guardian?
- Subject 1: Parents or guardians of international students, or relatives 21 years of age or older and nominated by the student's parents or guardians. Capable of providing accommodation, finance and support to international students. Do not bring family members younger than 6 years of age (Except in certain cases).
- Subject 2: Direct relatives in Australia as guardians. However, with the consent of parents and students.
- Subject 3: A representative from the school as a guardian. The school will issue an invitation letter called CAAW together with the COE to submit the visa. Usually public schools will not charge a fee, in some cases it will cost about 7 CAD/day.
3. What are the rights of a student's guardian?

When a parent or guardian holds a visa for a guardian in Australia, the following benefits are available:
- To live in Australia during the time as a guardian until the student is 18 years old
- Participate in any free English courses no more than 20h / week
- Participate in other courses in Australia but not more than 3 months
- Be free to enter and leave Australia for the duration of the visa, but not allowed to leave Australia without accompanying the student (Except in special cases which must be reported to the Department of Immigration)
This type of guardianship visa in Australia generally does not allow for work. Usually, a guardian is only allowed to take care of one student.
4. Responsibilities of Subclass 590 Visa holders?
The guardian, besides enjoying the above - mentioned special interests, shall also have certain responsibilities to fulfill such as:
- For the duration of the guardianship, the guardian must comply with visa requirements and the laws of Australia
- Must maintain health insurance for themselves and their students
- Ensure the provision of accommodation, basic social welfare and assistance for international students in study and travel.
- Communication and connection between families – schools – students; students – hosts – families in Vietnam
- Representing parents to work with the school. Including issues of diligence, ethics, learning attitudes of students
- Provide information about academic achievement to parents
- Also discuss with students in case of difficulty with the subject.
- If there is any change such as: change of passport, permanent residence, pregnancy, childbirth, marital status, etc., it is required to report to the Immigration Department through ImmiAccount or fill out form No. 929 for change of address and passport, form No. 1022 for change of personal status.
5. What is the duration of a Guardian Visa in Australia?
5 years – this is the maximum length of time a guardian can stay in Australia. Usually the guardian will stay in Australia for the duration of the student's studies or until the student is 18 years old and the duration should not exceed 5 years.

6. How is the application required?
A set of documents to apply for a guardian visa in Australia usually includes:
- Provisional Guardian Visa Application Form (Form 157N – this form is available on the www.border.gov.au
- 2 photos 4 x 6 cm (photos taken no more than 6 months)
- Household registration, passport, birth certificate, curriculum vitae, marital status (Notarized copy)
- Documents proving the relationship between the guardian and the student include the birth certificate of the guardian and the student. In case of appointment, there must be a letter of approval of the student's parent (Notarized copy)
- Proof that the applicant has arranged accommodation and health care for his/her dependent children under 18 years of age to stay in Vietnam
- If the applicant is working, then it must prove the current job through. Such as labor contract, confirmation signed and stamped head of the unit where he is working)
- Proof of financial support through proof of ability to pay travel and living expenses. Usually enough for 12 months for yourself and the student at least 19,830 AUD / year; And proof of spouse (who stays in Vietnam) will provide financial support with a minimum income of 70,000 AUD / year.
7. How long does it take to process a guardian visa application?
Normally, the processing time for a guardian's application in Australia will last up to 4 months. And is submitted separately from student visa applications. As the two above applications are considered separately.
