Vietnam joins the Apostille Convention on 11/9/2026: changes to using Vietnamese documents abroad

From the date 11/9/2026, an important change in the field of certification and use of public papers between Vietnam and foreign countries officially came into effect: Vietnam became a member of the Hague Convention on 5 October 1961 on the exemption of legalization requirements for foreign public documents, commonly known as Apostille Convention.

This is a remarkable step in simplifying the process of using cross-border public paperwork, especially for those who often have to prepare dossiers study, work, settle down, get married or carry out administrative procedures abroad.

According to information from the Hague Conference on International Justice (ICJ), Vietnam submitted its Instrument of Accession to the Convention on the 31/12/2025 and the Convention shall enter into force in Vietnam from the date 11/9/2026.

What is the Apostille?

Simply put, Apostille is a type of certificate issued to confirm the origin of public documents, so that it can be used in another member state without having to go through a traditional consular legalization process.

Apostille confirms factors such as:

  • The authenticity of signatures on papers;
  • - The title of the person who has signed the papers;
  • The seal or stamp of the competent agency on the paper.

It's important to note that Apostille does not confirm the content of the papers as true or false. This is the mechanism for certifying the form and origin of documents under the Convention.

How was the use of overseas paperwork in the past?

When a Vietnamese public paper is used abroad, depending on each country and each type of dossier, the citizen may have to take the steps of consular certification, then continue to carry out the procedures for consular legalization at the representative office of the country where the paper is used.

This process can cost people extra time and has to carry out many procedures at different agencies.

The Apostille Convention was designed to Replacing the multi-step legalization process with a single certification mechanism – Apostille, when the applicable conditions of the Convention are met.

This is why the Convention is often referred to as “Convention on the Exemption of Legalization”.

🇻🇳 What does it mean to join the Apostille Convention?

Vietnam's accession to the Convention may provide many advantages for the circulation and use of public papers between Vietnam and its member states.

In particular, for Vietnamese who wish to use papers abroad, the procedures for certification of papers in cases falling within the scope of the Convention can be greatly simplified.

Groups of documents that may be relevant include:

🎓 Study Abroad Profile: graduation diplomas, transcripts, study papers and other public papers at the request of the receiving agencies.

💼 Labor records: personal documents, diplomas, administrative papers in service of job application or qualification recognition in foreign countries.

🏠 Settlement record: birth certificates, marriage registration certificates, civil status papers and other public documents.

💍 Dossier of marriage to a foreigner: civil status documents and public documents required in the marriage registration procedure.

📄 Other administrative and legal procedures requirement for use of Vietnamese public papers in foreign countries.

⚠️ Is it from September 11, 2026 that all papers do not need consular legalization?

No.

This is a very important point that people need to understand correctly.

Vietnam's Participation in the Apostille Convention does not mean that all Vietnamese documents used in all countries are automatically exempt from consular legalization.

The Convention enters into force in the relations between Vietnam and States Parties Do Not Oppose Vietnam's Accession within the prescribed time limit.

According to the Ministry of Justice, Vietnam's accession is only valid in relations with member states that do not raise objections; for states falling into this case, the Convention shall take effect from the date of its signing. 11/9/2026.

Besides, the paperwork must also be scope of application of the Convention.

Therefore, before making the dossier, it is necessary to simultaneously check:

1. Does the country where the documents are used belong to the applicable relation of the Convention with Vietnam?

2. Is the document to be used within the scope of the Convention?

3. Does the receiving authority in the host country require additional translations, authentication or other conditions?

Only when all three of these factors are correctly determined can the application be concluded that it is possible to use the Apostille in place of the previous consular legalization process.

📌 Does Apostille replace translation?

No.

Apostille and translation are two different issues.

Apostille is intended to confirm the origin, signature, title and seal of the document. Meanwhile, overseas dossier-receiving authorities may still require the document to be translated into the language of the receiving country or an accepted language.

Depending on the country, agency and type of document, the translation may have to meet specific requirements for translators, authentication or presentation.

Therefore, “no consular legalization necessary” does not mean “just take the papers to be used immediately abroad”

🌏 This change is especially noticeable with international profiles

In recent years, the demand for Vietnamese papers in foreign countries is increasingly common.

A dossier for study abroad, labor, settlement or family reunion can include a wide variety of public documents. Applying the Apostille mechanism in appropriate circumstances can help reduce certification steps and create more favorable conditions for people, businesses and organizations when carrying out cross-border procedures.

The HCCH said with Vietnam's accession, the 1961 Apostille Convention had 129 countries/territories are members at the time of Vietnam's accession.

What do the applicants need to note from September 11, 2026?

If are preparing paperwork for use abroad, instead of defaulting to carry out the old procedure, residents should check in advance:

✔ Country of application

✔ Type of papers to use

✔ Purpose of paper use

✔ Does that country apply the Apostille Convention to Vietnam or not

✔ Apostille requirements, translations and authentication by the receiving authority

Pre-checking will help limit the condition redundancy of procedures, incurring costs or having to re-perform the dossier.
